Instructions on Utilizing Motion Set Hearing
After completing the Motion Set Hearing form, it is essential to submit it to the appropriate court. The form should be filed with the court clerk and a copy must be served to the respondent. Following these steps carefully will ensure the process is smooth.
- Fill in the cause number at the top of the form to match the cause number from the Petition.
- Write the names of both parties in the IN THE MATTER OF THE MARRIAGE OF section, filling in the full name of the Petitioner and Respondent.
- Enter the court number and specify whether it's a District Court or County Court at Law.
- Include the county name where the court case is being filed.
- In the Petitioner’s motion section, print your full name as the Petitioner.
- State the date and time for the hearing, along with the title of the motion being heard or mark it as “Final Trial”.
- Estimate and write down the total hours/minutes needed for the hearing.
- Sign the form and print your name in the Petitioner’s Signature and Petitioner’s Name sections.
- Provide your phone number and mailing address.
- Include the date when you completed the form.
- After filing, fill out the NOTICE SETTING HEARING section (this is usually done by the court clerk). Leave that section blank for them to complete.
- Complete the CERTIFICATE OF SERVICE section, stating how the respondent was served with the motion.
- Make sure to sign and date the CERTIFICATE OF SERVICE section as well.
